Terms and Conditions of Accommodation

Article 1. Scope of Application

1.
An accommodation agreement and related agreements to be entered into between COFF (hereinafter the "Hotel") and a guest is governed by these Terms and Conditions. Any matters not provided for herein shall be governed by the laws and regulations or generally accepted practices.
2.
Notwithstanding the preceding paragraph, in cases where the Hotel made a special arrangement with the guest within the scope permitted by the laws and regulations and generally accepted practices, the special arrangement shall prevail over these Terms and Conditions.

Article 2. Application for Accommodation Agreement

1.
A person who intends to make an application for an accommodation agreement with the Hotel shall notify the Hotel of the following information:
  1. the name of the guest(s);
  2. the period of stay and estimated time of arrival;
  3. the applicable hotel rate plan and room charges; and
  4. other matters as may be deemed necessary by the Hotel.
2.
In cases where the guest requests, during his/her stay, extension of the accommodation beyond the period set forth in item (ii) of the preceding paragraph, the guest is deemed to have made a new application for an accommodation agreement at the time of making such request, and the Hotel treats the guest accordingly.

Article 3. Conclusion of Accommodation Agreement

An accommodation agreement comes into effect when the Hotel has accepted the application under the preceding Article (Application for Accommodation Agreement). However, this shall not apply to the case where the Hotel is proved not to have accepted the application.
2.
When the accommodation agreement has been concluded in accordance with the preceding paragraph, the guest shall, by the date designated by the Hotel, pay an accommodation deposit determined by the Hotel which shall not exceed the basic room charges, covering the guest's entire period of stay (or three days, if the period exceeds three days).
3.
The deposit shall be first appropriated to the room charges to be finally paid by the guest, then to the cancellation charges under Article 6 (Right of Cancellation by Guest), and then to the compensation of damages under Article 18 (Responsibility of Guest). The remainder, if any, shall be refunded at the time of payment of the charges under Article 12 (Payment of Charges).
4.
If the guest fails to pay the deposit under paragraph (2) by the date designated by the Hotel in accordance with the same paragraph, the accommodation agreement ceases to be in effect. However, this only applies to the case where the Hotel has informed the guest to that effect upon the notice of due date of payment of the deposit.

Article 4. Special Arrangement for Exemption of Deposit

1.
Notwithstanding paragraph (2) of the preceding Article (Conclusion of Accommodation Agreement), after the accommodation agreement comes into force, the Hotel may make a special arrangement exempting the guest from the payment of accommodation deposit under the same paragraph.
2.
In cases where the Hotel has not required the payment of the deposit as set forth in paragraph (2) of the preceding Article (Conclusion of Accommodation Agreement) or has not designated the due date of the payment of the deposit at the time of accepting the application for accommodation agreement, the Hotel is deemed to have made the special arrangement referred to in the preceding paragraph.

Article 5. Refusal of Accommodation Agreement

The Hotel may refuse to enter into an accommodation agreement in any of the following cases:

  1. An application for accommodation was not made in accordance with these Terms and Conditions;
  2. The Hotel is fully booked and no room is available;
  3. The applicant for accommodation is deemed liable to conduct him/herself in a manner that will contravene the laws or act against the public order or good morals in regard to his/her accommodation;
  4. The applicant for accommodation is determined to fall under any of the following:
    (a)
    an organized crime group as defined in Article 2, item (ii) of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991)(hereinafter an "Organized Crime Group"), a member of an organized crime group as defined in Article 2, item (vi) of the same Act (hereinafter an "Organized Crime Group Member"), a quasi-member or related party of an Organized Crime Group, or a member of any other antisocial force;
    (b)
    a corporation or other entity whose business is under the control of an Organized Crime Group or Organized Crime Group Member; or
    (c)
    a corporation that has an officer who is an Organized Crime Group Member;
  5. The applicant for accommodation risks significantly annoying other guests through his/her words and deeds;
  6. The applicant for accommodation obviously is a patient with an infectious disease;
  7. The applicant for accommodation makes a request in a violent manner or an undue request beyond the reasonable scope in relation to his/her accommodation;
  8. The Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities or other unavoidable reasons;
  9. A provision of the prefectural or municipal ordinance, or other laws and regulations including ministerial orders and other orders applies; or
  10. In cases where the applicant for accommodation is under the age of 20 or a person who requires the attendance of his/her guardian under the laws, and where the applicant is not accompanied by his/her guardian; however, this shall not apply to the case where the guardian had given prior written consent.

Article 6. Right of Cancellation by Guests

1.
The guest may cancel the accommodation agreement by notifying the Hotel to that effect.
2.
If the guest cancels the accommodation agreement in whole or part due to a reason attributable to himself/herself, the Hotel will charge cancellation charges according to Appended Table 2 (excluding the case where the Hotel requested the guest to pay the deposit by designating the due date of payment thereof according to Article 3, paragraph (2) (Conclusion of Accommodation Agreement), and where the guest cancels the accommodation agreement before the payment of deposit). However, if the Hotel made a special arrangement referred to in Article 4, paragraph (1) (Special Arrangement for Exemption of Deposit), the above only applies to the case where the Hotel had informed the guest of his/her obligation to pay the charge in case of cancellation of the accommodation agreement at the time of making the special arrangement.
3.
If the guest does not arrive at the Hotel before 10:00 PM (or before the designated time, if the Hotel is expressly informed of the estimated time of arrival in advance) of the day of accommodation without notice, the Hotel may deem that the guest had cancelled the accommodation agreement.

Article 7. Right of Cancellation of Agreement by Hotel

1.
The Hotel may cancel the accommodation agreement in the following cases:
  1. The guest is deemed to have conducted, or is deemed liable to conduct, him/herself in a manner that will contravene the laws or act against the public order or good morals in regard to his/her accommodation;
  2. The guest is deemed to fall under any of the following:
    (a)
    an Organized Crime Group, Organized Crime Group Member, a quasi-member or related party of an Organized Crime Group, or a member of any other antisocial force;
    (b)
    a corporation or other entity whose business is under the control of an Organized Crime Group or Organized Crime Group Member; or
    (c)
    a corporation that has an officer who is an Organized Crime Group Member.
  3. The guest risks significantly annoying other guests through his/her words and deeds;
  4. The guest obviously is a patient with an infectious disease;
  5. The guest makes a request in a violent manner or an undue request beyond the reasonable scope in relation to his/her accommodation;
  6. The Hotel is unable to provide accommodation due to force majeure including natural disasters;
  7. A provision of the prefectural or municipal ordinance, or other laws and regulations including ministerial orders and other orders applies; or
  8. The guest smokes in a manner that does not comply with the designated place, damages or misuses fire protection facilities in a frivolous way, or otherwise fails to comply with avoidance of the prohibited activities provided in the Terms of Use of the Hotel.
2.
If the Hotel cancels the accommodation agreement in accordance with the preceding paragraph, the Hotel will not charge any fees for the services including accommodation services which have not been provided to the guest.

Article 8. Registration

1.
The guest shall register the following particulars at the reception of the Hotel on the first day of accommodation.
  1. the name, age, sex, address and occupation of the guest(s);
  2. for non-Japanese guest, the nationality, passport number, port and date of entry in Japan;
  3. the date and estimated time of departure;
  4. the car registration number, if the guest parks his/her car at the Hotel; and
  5. other particulars deemed necessary be the Hotel.
2.
In cases where the guest intends to pay his/her room charges set forth in Article 12 (Payment of Charges) by any means other than cash, such as coupons or credit cards, these means shall be presented in advance at the time of the registration under the preceding paragraph.

Article 9. Occupancy Hours of Guest Rooms

1.
The guest is entitled to occupy the reserved guest room of the Hotel from 3:00PM on the day of arrival to 10:00AM on the day of departure. In the case where the guest stays for more than one day, the guest may occupy it for an entire day, except for the days of arrival and departure.
2.
The Hotel may permit the guest to occupy the room from 10:00AM to 6:00PM to allow the guest to take rests or shower. In such case, time-based charges determined by the Hotel apply.

Article 10. Compliance with Terms of Use

While staying at the Hotel, the guest shall comply with the Terms of Use and Pet Dog Policy of the Hotel announced at the hotel premises.

Article 11. Business Hours

1.
The main facilities of the Hotel shall be open during the following hours, and the business hours of other facilities shall be announced in detail by brochures provided by the Hotel, notices displayed in various places, the Guide to the Hotel in guest rooms, and other means.
  1. Service hours of reception:
    A. Curfew:

    B. Reception services:
    from 7:00AM to 11:00PM
  2. Service hours of restaurants:
    A. Breakfast:
    7:30 AM-9:00 AM (closed at 9:30 AM)
    B. Dinner:
    6:00 PM-8:00 PM (closed at 9:00 PM)
    C. Other food and beverage services:
    3:00 PM-10:00 PM
  3. Service hours of other facilities:
    A. Lounge on the 1st floor of Main Building:
    3:00 PM-10:00 PM
    B. Japanese room on the 1st floor of Main Building:
    3:00 PM-10:00 PM
2.
The business hours specified in the preceding paragraph are subject to a temporary change under unavoidable circumstances. In this case, the Hotel will make an announcement by appropriate means.

Article 12. Payment of Room Charges

1.
The breakdown the room charges, etc. payable by the guest shall be as set forth in Appended Table 1.
2.
Room charges, etc. as referred to in the preceding paragraph shall be paid in cash or other means permitted by the Hotel, including coupons and credit cards, at the reception at the time of the arrival of the guest or upon the request by the Hotel.
3.
Room charges shall be paid if the guest did not use the room based on his/her own will as long as the Hotel made the room available for use by the guest.

Article 13. Liability of Hotel

1.
The Hotel shall compensate the guest for damage caused by the Hotel as a result of the performance or non-performance of its obligations under the accommodation agreement and related agreements. However, the same shall not apply to cases where such damage was not attributable to the Hotel.
2.
The Hotel has taken out a hotel liability insurance policy so as to cover the damages caused by fire and other disasters.

Article 14. Unavailability of Rooms

1.
In the case of unavailability of the room agreed with the guest, the Hotel shall make an arrangement for an alternative accommodation facility of the same standard to the extent practicable, with a consent from the guest.
2.
Notwithstanding the preceding paragraph, if the Hotel is unable to make an arrangement for the alternative accommodation facility, it shall make a compensation payment equivalent to the cancellation charge to the guest, which shall be appropriated with the compensation of damages. However, the Hotel is not liable to make the compensation payment if the unavailability of the room is not attributable to the Hotel.

Article 15. Handling of Deposited Articles

1.
For any goods, cash or valuables deposited with the reception by the guest, the Hotel shall compensate the guest for the damage caused by the loss or destruction or other damage, except in the case where such damage was caused by force majeure. However, for cash and valuables, if the guest did not report the nature and value thereof in spite of the request from the Hotel, the Hotel is liable to compensate for the damage within the limits of JPY150,000 or the amount covered by the hotel liability insurance.
2.
For any goods, cash or valuables carried by a guest with him/her to the Hotel but not deposited with the reception, the Hotel shall compensate the guest for the damage caused by the loss or destruction or other damage as long as such damage is attributable to a willful misconduct or negligence of the Hotel. However, if the guest did not report the nature and value thereof in advance, the Hotel is liable to compensate for the damage within the limits of JPY150,000 or the amount covered by the hotel liability insurance, unless the damage is attributable to a willful misconduct or gross negligence of the Hotel.

Article 16. Custody of Baggage or Belongings of Guest

1.
When the baggage of a guest is received by the Hotel before his/her arrival, the Hotel shall be liable to keep it only in cases where the Hotel had consented to keep custody thereof before the arrival. The baggage shall be handed over to the guest at the reception at the time of his/her check-in.
2.
When the baggage or belongings of the guest is found to be left after his/her check-out, and the ownership of the article is ascertained, the Hotel shall inform the owner of the article left and ask for further instructions. However, when no instructions are given to the Hotel by the owner or if the ownership cannot be ascertained, the Hotel shall keep the article for 10 days including the day it is found, and after this period, the Hotel shall make efforts to turn it over to the nearest police station in principle. Please note, however, that if the Hotel determines the value of the article to be very small, the Hotel may dispose of the article by any means at the cost and responsibility of the guest, deeming that the guest has surrendered the ownership or control of such article.
3.
For the responsibilities of the Hotel in relation to the custody of baggage or belongings of the guest as referred to in the preceding two paragraphs, the provisions of Article 15(1) apply to paragraph (1), and Article 15(2) to paragraph (2), respectively.

Article 17. Liability in regard to Parking

For the use by the guest of the Hotel's parking lot, the Hotel merely provides the space and is not liable for the management of the vehicle, regardless of whether the guest deposits with the Hotel the key of his/her vehicle. However, the Hotel shall be liable to compensate the guest for the damage caused by willful misconduct or negligence on its part in regard to the management of the parking lot.

Article 18. Responsibility of Guest

The guest is liable to compensate the Hotel for the damages caused by any willful misconduct or gross negligence of the guest.

Article 19. Special Agreement

These Terms and Conditions of Accommodation are subject to change without prior notice, due to a change in the Hotel's management policy, or the enactment or amendment of the laws and regulations referred to in Article 5(1)(ix) and Article 7(1)(vii).

Remarks
1.
The charges will be publicized on the website of the Hotel.
2.
Child rate is applicable to elementary school children or younger children. For a child who requires bedclothes for adult, 70% of the adult rate is applied. There is no charge for children under school age who require no bedclothes or meals from the Hotel.

Remarks
1.
"%" represents the cancellation charge's percentage of the room charge.
2.
In the case of a decrease in the number of days of stay, the guest is required to pay a cancellation charge for one day (the first day), without regard to the number of days decreased.
3.
In the cases of a reservation for a group of 10 persons or more, if the accommodation agreement was cancelled for only a part of the group members, the Hotel will not charge a cancellation fee for the number of persons up to 10% of the number of guests (the fraction is rounded up) as of the day 10 days prior to the accommodation (or, as of the day of the acceptance of reservation, if the reservation is accepted after a day 10 days prior to the accommodation).
